Town aware of low-level water pollution from gas additive since 2009; files lawsuit Tuesday

the lawThe Town of Hinesburg has filed a suit against a who’s-who of oil corporations, citing groundwater pollution from the gasoline additive MTBE.

Filed Tuesday at U.S. District Court in Burlington, the suit states the defendants “needlessly and recklessly” added the chemical to fuel, and “unleashed an unprecedented assault” on Vermonters’ water supplies.

Hinesburg seeks a jury trial to determine punitive damages, costs of remediation and legal fees.

The town’s case might be consolidated with more than 100 similar suits in a pending action in the U.S. Southern District of New York, according to the town’s legal team.

Low levels of contamination have been detected in Hinesburg’s principal water supply since 2009, according to the municipal website.
